This Privacy Policy describes the personal information that Kiva collects through the Zip Website or otherwise as part of all transactions conducted on the Zip Website and all Kiva services provided in connection with the Zip Website (the “Alpha Program”), as well as the ways that Kiva collects, uses, discloses, stores and protects such personal information. This Privacy Policy may be modified by Kiva from time to time and such modifications shall automatically become part of this Privacy Policy and shall be effective once posted by Kiva on the Zip Website (as indicated by the posted update date). Your participation in the Alpha Program and use of the Zip Website will be subject to any such modifications. By accessing or using the Zip Website, you signify that you have read this Privacy Policy, and you expressly consent to our collection, use, disclosure, storage and protection of your personal information as described in this Privacy Policy.

1. Information Kiva collects and how it is collected and used

Kiva collects your personal information directly from you when you register on the Zip Website or otherwise join the Alpha Program and if you choose to provide additional personal information during your subsequent use of the Zip Website or participation in the Alpha Program. Some personal information is required and some is optional. You can share as much or as little optional personal information as you like. The optional personal information you choose to share on the Zip Website is entirely your own choice, and you share this information at your discretion.

Information you provide to Kiva. Personal information that is required when you register on the Zip Website includes your name, email address, a means to authenticate your account (for example, a password), gender and time zone. Kiva requires this information so that you may log in to the Zip Website, as well as to personalize the content provided to you on the Zip Website and in the Alpha Program.

If you are registered as a Trustee or Zip Borrower, Kiva requires and collects additional personal information directly from you to determine your eligibility as a Trustee or Zip Borrower and, for the categories of this information that we indicate is public information, to display on the Zip Website to all Zip Website Users. If you are registered as a Trustee, the types of personal information Kiva requires and collects from you include information regarding you, your impact, your activities and thoughts in connection with Zip Borrower due diligence and the Alpha Program, and your photo. If you are registered as a Zip Borrower, the types of personal information Kiva requires and collects from you generally includes financial and credit data, including your date of birth, business-related financial information, household information, income and income sources, savings, credit score, credit history, outstanding debts, as well as general information about you (including your photo), your business, your loan and, in some cases, your Social Security number or equivalent identification number and your credit report.

Kiva collects personal information directly from you when you provide Kiva with updates to your personal information, whether through the Zip Website or by contacting Kiva. You can review the personal information you submit on the Zip Website at any time. If you are registered as a Lender or Trustee, you can update the information you have provided about yourself to Kiva for your profile page and account by logging in to your account on the Zip Website, clicking on the "Edit profile" or “Edit account” links and making changes to you profile or account, as necessary. If you are registered as a Zip Borrower, you can update your personal information by contacting Kiva as described in Section 6 below.

Kiva reserves the right to permit discussion between Zip Website Users in forums public to some or all Zip Website Users. If you are a Lender, your participation in any forums on the Zip Website is optional and at your discretion. If you are a Trustee or Zip Borrower, any obligations that you may have to participate in any forums on the Zip Website are not governed by this Privacy Policy or the Zip Alpha Terms of Use but instead are governed by your respective Trustee or Zip Borrower agreement with Kiva. Notwithstanding the foregoing, all Zip Website Users acknowledge and agree that any information provided in public areas of the Zip Website may be read, collected and used by others who access them. To request removal of your personal information from a Zip Website forum, contact Kiva at contactzip@kiva.org. In some cases, Kiva may not be able to remove your personal information, in which case Kiva will let you know if Kiva is unable to do so and why. Kiva collects any personal information you choose to share by participating in these forums.

If you contact Kiva with a question or feedback regarding the Zip Website or Alpha Program, Kiva collects personal information directly from you in order to respond to your question or feedback.

Use of information you provide.Kiva uses the required and optional personal information that you provide to Kiva to facilitate activities and transactions for the operation of the Zip Website and Alpha Program, as well as to improve User experiences on the Zip Website and in the Alpha Program. For example, Kiva uses this information to populate your profile page, which is viewable by all Zip Website Users. If you are registered as a Lender, your profile page will automatically show your first name and location that you have provided to Kiva, as well as other optional information that you may provide to Kiva (including your photo and information about your activities and thoughts on Kiva). If you are registered as a Trustee, your profile page will automatically show the personal information that you have provided to Kiva in the portions of your application that we indicate is public. If you are registered as a Borrower and your Loan request is approved for posting by Kiva, your profile page will automatically include that Loan request, which contains the personal information that you have provided to Kiva in the portions of your application that we indicate is public.

Use of information from third parties.Kiva collects your personal information from third parties to facilitate activities and transactions for the operation of the Zip Website and Alpha Program, as well as to improve User experiences on the Zip Website and in the Alpha Program. For example, if you are registered as a Borrower, your profile page will automatically include information about you (including information about your creditworthiness, credit history, relationship with the Trustee, the soundness of your business plans, your character, and potential risks and challenges in your life) that a Trustee provides to Kiva. In addition, if you are registered as a Trustee, information about you (including information about the services you have provided to and your impact on the Zip Borrower) that a Zip Borrower provides to Kiva will automatically be included in the Borrower’s profile page. Other third parties from which Kiva may collect your personal information include payment processors and third party tools and programs enabled on the Zip Website, as discussed in more detail below in this Section 1.

Communications from Kiva. Kiva will use your personal information to contact you to facilitate activities and transactions for the operation of the Zip Website and Alpha Program, as well as to improve User experiences on the Zip Website and in the Alpha Program. For example, Kiva reserves the right to contact you (a) if there is a problem processing a transaction or to discuss a problem with your account, (b) to maintain regular communications with you about your account, activities and transactions on the Zip Website or in the Alpha Program (including without limitation to respond to your questions or feedback, to communicate with you about upcoming payments and fund transfer activity, and to provide Loan and Alpha Program updates and disclosures), and (c) to implement collection activities, as needed. In addition, Kiva reserves the right to contact you to promote Kiva’s mission, but you may choose to receive no further promotional emails from Kiva by following the unsubscribe or opt-out instructions provided in the promotional email.

Information from cookies and web beacons.Cookies are small text files created by a website that store information on your computer, such as your preferences when visiting that site. Similar to many websites, if you have enabled cookies in your browser, Kiva, independently and through enabled third party tools and programs, collects certain technical information using cookies, such as the path of users to the Zip Website, pages visited, originating IP address, browser type, browser language and the date and time of the user's visit. This information helps Kiva track trends and improve areas of the Zip Website and Alpha Program, and are common analytics used by most websites. If you have disabled cookies, the Zip Website may not work as it is intended because Kiva uses cookies when you sign in to keep track of your personal session. Web beacons are tiny graphics with a unique identifier that are similar in function to cookies but, instead of being stored on your computer, are embedded invisibly on web pages and are about the size of the period at the end of this sentence. Web beacons are used to track the online movements of internet users and help Kiva better understand User interaction and engagement with the Zip Website and Alpha Program (including without limitation, in electronic Communications).

2. Information that Kiva shares and with whom

No disclosure for third party marketing. Kiva does not disclose, sell or rent your personal information to third parties for their marketing purposes.

Disclosure to third party service providers. Kiva's affiliates, service providers, agents and representatives may be provided access to or otherwise given your personal information as part of, or incident to, their provision of services to Kiva (for example, processing Loan transactions, distributing Kiva emails, implementing collection activities, and reporting delinquencies and defaults). Kiva shares this information with these affiliates, service providers, agents and representatives in order to facilitate activities and transactions for the operation of the Zip Website and Alpha Program, as well as to improve User experiences on the Zip Website and in the Alpha Program. These affiliates, service providers, agents and representatives are bound by contract to maintain the confidentiality of your personal information.

Disclosure to Zip Website Users.If you are a registered Zip Website User, you will have a profile page that is viewable by all Zip Website Users and displays the personal information that you have provided to Kiva as described in more detail in Section 1 above. In addition, Kiva displays the following information about you on the Zip Website for all Zip Website Users to view:

Non-personally identifiable data. Kiva reserves the right to disclose information that does not directly identify you, for example, aggregated or anonymized data, for educational, informational or promotional purposes in furtherance of Kiva’s mission.

Legal disclosures. Notwithstanding anything to the contrary in this Privacy Policy, you acknowledge, consent and agree that Kiva may disclose information in order to: (a) comply with applicable law, regulation, legal process, or governmental request; (b) protect the rights, property and safety of Kiva, Users and others, including intellectual property rights; and (c) enforce or apply our agreements and policies.

3. Storing and Protecting Your Information

Security. Kiva takes reasonable steps to maintain appropriate physical, technical and administrative security to help prevent loss, misuse, and unauthorized access, disclosure and modification of personal information. While we take these reasonable efforts to safeguard your personal information, no system or transmission of data over the Internet or any other public network can be guaranteed to be 100% secure. You should not share the password to your Zip Website account with anyone.

Location of data. Kiva is headquartered in the USA. Your personal information may be accessed by Kiva, our affiliates, service providers, agents and representatives in the USA or elsewhere in the world. By providing us with personal information, you consent to this transfer. Kiva will protect the privacy and security of your personal information according to this Privacy Policy regardless of where the personal information is processed or stored.

Retention period. Kiva reserves the right to retain your personal information for a period of seven years or more to satisfy legal requirements such as recordkeeping and tax and credit reporting requirements, as well as for purposes of fraud prevention, audit and data integrity. In addition, Kiva reserves the right to retain, as well as to use and disclose as permitted pursuant to this Privacy Policy, your personal information for such period of time as reasonably needed by Kiva to facilitate activities and transactions for the operation of the Zip Website and Alpha Program, as well as to improve User experiences on the Zip Website and in the Alpha Program,. Kiva reserves the right to retain information that does not directly identify you, for example, aggregated or anonymized data.

4. Third party links

If you follow any links which remove you from the Zip Website (including to www.kiva.org), this Privacy Policy no longer applies. Kiva does not control the privacy policies or the privacy practices of any third parties and use of sites other than the Zip Website are governed by the respective terms of use and privacy policies posted on those sites.

5. Note Regarding Children Under 18

You may not register for an account on the Zip Website unless you are 18 years of age or older. Children under the age of 18 are not eligible to participate in the Alpha Program.
